Drug charges in Thailand

This is the heaviest category of case a foreign national faces in Thailand, and the one where the first few hours are least recoverable. The line between possession for personal use and possession for supply is drawn not only by weight, but by what was said and signed at the station.

What matters in the first hours

This list is first aid, not a substitute for counsel. Call and describe the situation: from there it is safer to act on a lawyer’s assessment than on a general checklist.

  1. Sign nothing — not in Thai, not in English, not "just the inventory".
  2. Do not explain where the substance came from. Any explanation is recorded and later read against you.
  3. Do not accept an admission described as a formality. On these charges it shapes everything that follows.
  4. Demand a lawyer and an interpreter immediately.
  5. Do not attempt to pay your way out. On this category that reliably produces a second case.
  6. Family: call straight away, do not wait for morning.

What determines the severity

  • The category of the substance. Thai law separates substances into categories with very different penalties.
  • Quantity and weight. Thresholds move a case from one characterisation to another.
  • Packaging. Several separate wraps is the standard prosecution argument for supply.
  • Scales, cash, message history, and any evidence of a handover.
  • Where the arrest happened and to whom the substance is attributed in the file.
  • What co-defendants have said about the same incident.

Where defences usually collapse

Under stress, people explain to the police "how it really was", assuming candour will help. What reaches the record is not the whole story but a sentence that later reads as an admission.

The second pattern is signing a Thai-language document. The signatory does not know what it says; the court treats it as evidence.

The third is trying to negotiate privately, which converts one case into two — and the second is often the more serious.

What the defence works on

  1. Procedure

How the search was conducted, who witnessed it, how the seizure was recorded, who opened the packaging and when.

  2. Forensics

Who tested the substance, by what method, and whether weights and quantities match across the file.

  3. Characterisation

Moving a charge from supply to possession changes the sentence by an order of magnitude. This is where effort pays.

  4. Bail

The application is made even where prospects are poor: the refusal fixes a position that can be revisited at the next stage.

  5. Mitigation

Where the facts cannot be contested, the work is on the lowest available sentence and on alternatives to custody.

A note on cannabis

The legal status of cannabis in Thailand has changed several times in recent years and continues to be refined by regulation. "It is legal, there are shops" is not an argument in a case file: what matters is the rules in force on the date, the form of the product, its composition and the purpose.

The separate trap is carrying it out of the country. Something bought lawfully in Thailand can be a serious offence at the departure or arrival airport.

Frequently asked questions

Is bail granted on drug charges?
On minor matters, regularly. On supply allegations and large quantities, courts refuse often. The application is still worth making, because it fixes a position that can be revisited.
What is the penalty for possessing a small amount?
The range is wide — from fines and treatment measures to imprisonment — depending on the category of the substance, the quantity and the charge. A precise answer is only possible once the section and the file are known.
I was made to give a sample. Was that lawful?
Taking samples during an investigation is provided for, but the procedure has requirements: grounds, recording, explanation of rights. Defects at this stage are a working line of defence and should be recorded immediately.
Will pleading guilty reduce the sentence?
Sometimes — a plea is treated as mitigation. But it should be entered to a charge that is actually provable, and to the more favourable characterisation. That decision belongs after counsel has read the file, not during the interview.
It was not mine, I was just there.
That is a common and workable position, but it has to be built from day one: whose belongings, who opened what, what the others are saying. A person who first "explained everything" and then changed position is viewed sceptically by the court.
Is deportation automatic after a sentence?
In practice it usually follows, together with an entry ban. Immigration consequences are worked out alongside the criminal defence rather than after judgment.

Need a lawyer right now?

A duty lawyer answers around the clock. If you or someone close to you has been detained, call without waiting for morning: the first hours matter more than the rest of the case.
