Immigration offences and entry bans

Deportation is an administrative process; the entry ban that follows it stays with a person for years. The difference between leaving voluntarily and being removed is decided in the first days, while the paperwork is still open.

If immigration police have detained someone

This list is first aid, not a substitute for counsel. Call and describe the situation: from there it is safer to act on a lawyer’s assessment than on a general checklist.

  1. Find out where they are: an immigration office, the detention centre in Bangkok, or a police station.
  2. Sign nothing before taking advice. Some of those documents amount to consent to removal.
  3. Do not pay anyone to make it go away. Official payments are made at a counter and receipted.
  4. Gather documents: passport, visa history, entry stamps, tenancy agreement, employment papers.
  5. Call us. In this category the timeline is days, not weeks.

What leads to removal

  • Overstay, particularly a long one.
  • Working without a work permit.
  • A criminal conviction and the sentence that follows it.
  • Breach of visa conditions, where actual activity does not match the stated purpose.
  • Being designated an undesirable person by the immigration authorities.
  • Forged documents used on entry or extension.

Voluntary departure is not the same as removal

A person who leaves on their own, before or shortly after the permitted period expires, faces a fine and, for a long overstay, a ban of a defined length.

A person who is detained and removed acquires a deportation record in addition. It is visible at every subsequent border crossing and affects visa decisions well beyond Thailand.

So the first objective is almost always the same: keep the case on the departure side of that line. It is not always possible, but it has to be tested before the removal order is signed.

How the process runs

  1. Detention

A document check on the street, at an extension appointment, at the border, or after a raid.

  2. Processing

The breach is recorded, a fine assessed, and the question of custody decided.

  3. Detention centre

Where immediate departure is impossible the person is held pending removal. How long depends on documents and flights.

  4. Departure

Departure at the person’s own expense under supervision, or enforced removal.

  5. Record

The ground and the length of the entry ban are entered into the system.

What can be done

  • Speed up the paperwork and shorten time spent in detention.
  • Secure departure at the person’s own expense instead of enforced removal, where that is still open.
  • Challenge the ground where no breach occurred or it has been characterised incorrectly.
  • Prepare a petition to lift or shorten an entry ban.
  • Check whether a ban is actually recorded before a ticket is bought, rather than at the check-in desk.

Frequently asked questions

How do I find out whether I am banned from Thailand?
Not by yourself: there is no public lookup. Status is established by enquiry to the Immigration Bureau, and it is worth doing before travelling rather than at passport control.
Can an entry ban be lifted?
In some cases, by petition to the Immigration Bureau with supporting grounds. Prospects depend on the reason for the ban, its length, how much time has passed and what the person can show — family, business, a clean record since. Nothing happens automatically.
Does a Thai deportation affect visas elsewhere?
There is no automatic effect, but many visa forms ask whether you have ever been deported, and an inaccurate answer creates a separate problem. Answering correctly requires knowing exactly how the departure was recorded.
How long can someone be held at the detention centre?
From days to months. It depends mostly on whether there is a valid passport, whether a ticket is paid for, and whether a criminal case is running in parallel. That timeline is where a lawyer makes a difference.
Who pays for the flight out?
Usually the person or their family. Not having the fare is one of the main reasons people remain in detention for long periods.
I have a Thai spouse and child. Does that count?
Family circumstances are taken into account both on removal and on a petition to lift a ban, but they do not cancel the breach. They need to be documented and put properly.

Need a lawyer right now?

A duty lawyer answers around the clock. If you or someone close to you has been detained, call without waiting for morning: the first hours matter more than the rest of the case.
